The Services offer users a range of personalization features designed to enhance their music listening experience. These include the ability to create and manage personal playlists using licensed content available on the platform, mark content as "Favourites," share content links externally via supported integrations, browse music by artist, access curated top charts and trending sections, utilize in-app search capabilities, and manage preferences through general settings.
Users may also maintain a limited user profile linked to their registered account. However, users are not permitted to upload or distribute any content, audio files, or media through the Services. Users acknowledge and agree that all content accessed through the Services — including music tracks, artwork, metadata, artist information, and playlist arrangements — remains the sole and exclusive intellectual property of Hungama and/or its licensors. The creation of personal playlists or marking of favourite tracks is permitted solely for non-commercial, personal use. Such playlists, although reflective of user preferences, do not confer any ownership, copyright, or license over the underlying musical works.
Hungama reserves the right, in its sole discretion, to monitor, restrict, or remove any user-generated playlists or activity that is found to be inconsistent with licensing agreements, community guidelines, or applicable laws. Users are strictly prohibited from using automated tools, bots, or scripts to generate, export, or exploit playlist data from the Services.

Hungama content partners or content aggregators may post, upload or otherwise contribute content to the Mobile App which may include, for example, audio, video, media, pictures, texts, messages, information, playlist titles, descriptions and compilations.
Hungama strives to provide you access to a rich and diverse catalogue of music across multiple languages and genres. However, from time to time, certain tracks, albums, or other content may appear as removed, disabled, greyed out, or marked as "Unavailable" on the Hungama Music app or website.
Any such limitation is imposed by the music labels, copyright owners, or distributors who control the rights to the Content. These restrictions may apply based on geographical location, device/platform, or user subscription type.
In rare cases, music may become temporarily unavailable due to a lapse in the renewal of licensing agreements or changes in ownership of the rights. Some Content, especially international or English tracks, may be restricted to users select countries due to region-specific licensing terms. In certain cases, rights holders may choose to make their content accessible only to premium (Pro) subscribers. This restriction is applied by Hungama only upon request from the rights holder.
If a song becomes unavailable, Hungama will never remove it from your playlists. The track will be restored automatically if and when it becomes available again under a valid license. You may continue to see such songs in your playlists with an "Unavailable" tag. Hungama continuously works with rights holders to expand its catalogue and ensure that the most popular, trending, and classic tracks are made available to its users in compliance with applicable copyright laws.
You agree not to host, display, upload, modify, publish, transmit, update or share any Content which:
belongs to another person and to which you do not have any right to;
is grossly insulting, harmful, blasphemous defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy including bodily privacy, hateful, harassing on the basis of gender, racially or ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or an online game that causes user harm, hurts the religious sentiments of any community or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence, spreads misinformation pertaining to established facts or otherwise inconsistent with or contrary to the laws in force;
harm minors in any way;
infringes any patent, trademark, copyright or other proprietary rights;
violates any law for the time being in force;
deceives or misleads the addressee about the origin of such Content or communicates any Content which is grossly offensive or menacing in nature or, in respect of any business of the Central Government, is identified as fake or false or misleading by such Government or Authority, by way of notification as may be published or specified. impersonate another person;
contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
is in the nature of an online game that is not verified as a permissible online game;
is in the nature of advertisement or surrogate advertisement or promotion of an online game that is not a permissible online game, or of any online gaming intermediary offering such an online game;
threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation;
contains and/or spreads misleading information regarding the origin of the content;
is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person or otherwise contains any objectionable content.
Any Content shared by You shall be subject to applicable laws and regulations and may be disabled, subject to a take down, or may be subject to an investigation under appropriate laws. Furthermore, if you are found to be in non-compliance with the applicable laws and regulations, these Terms of Use and/or the Privacy Policy, Hungama, at its sole discretion, shall have the right to terminate your account and/or block your feed or access to the Services. Users may create custom playlists using available Content on the Platform. These playlists remain the intellectual property of Hungama insofar as they use licensed musical works, although the selection and arrangement by the user may reflect their personal preferences. Hungama reserves the right to monitor and remove any user-generated playlists that violate licensing terms or community standards.

You agree and understand that you are responsible for not automating account creation. You are also responsible for maintaining the confidentiality of OTPs associated with any account you use to access the Services. Accordingly, you agree that you will be solely responsible to Hungama for all activities that occur under your account. Hungama is not responsible whatsoever for any actions taken under your account. If you become aware of any unauthorized use of your OTP or login or of your account, you agree to notify Hungama immediately at support@hungama.com

You understand that all Content which you may have access to as part of, or through your use of, the Services is the sole responsibility of the source from which such content originated. All such information is referred to here as the "Content". Hungama does its best to give proper credit to the source from which the data was indexed. Hungama's search engine lays no claim to the ownership of the content originated at these sites. If some Content is cached, it is done for the sole purpose of providing users with the best possible service. If you think that any Content is objectionable, please inform Hungama at your convenience.
Hungama respects the intellectual property of others, and we ask our users to do the same. If you believe that your work is used in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please send a notice of copyright infringement containing the following information to legal@hungama.com A signature (electronic or physical) of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest that has been allegedly infringed.
A description of the copyrighted work or other material being infringed.
identification of the material that is claimed to be infringing including information regarding the location of the infringing materials that the copyright owner seeks to have removed, with sufficient detail so that Hungama is capable of finding and verifying its existence;
The notifier's address, telephone number, and email address.
A statement that the notifier has a good faith belief that the material identified is not authorized by the copyright owner, its agent, or the law.
A statement made under penalty of perjury that all the above information is accurate, and that the notifying party is authorized to act on the behalf of the copyright owner.
You agree that you are solely responsible for (and that Hungama has no responsibility to you or to any third party for) any Content that you create, transmit, or display while using the Services and for the consequences of your actions (including any loss or damage which Hungama may suffer) by doing so.
You understand that by using the Services you may be exposed to Content that you may find offensive, indecent, or objectionable and that, in this respect, you use the Services at your own risk.

Unless you have agreed otherwise in writing with Hungama, nothing in the Terms gives you a right to use any of Hungama's trade names, trademarks, service marks, logos, domain names, and other distinctive brand features. You agree that you shall not remove, obscure, or alter any proprietary rights notices (including copyright and trademark notices), which may be affixed to or contained within the Services. Unless you have been expressly authorized to do so in writing by Hungama, you agree that in using the Services, you will not use any trade mark, service mark, trade name, or logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names or logos.
Hungama Music has obtained all necessary licenses, including public performance, mechanical, synchronization, and digital streaming rights, from rights holders or their authorized representatives to make music content available on this Platform in the listed territories.
Access to songs may vary across territories due to contractual limitations with licensors. Users acknowledge that Hungama does not guarantee the availability of specific content at all times or in all regions.

The Services may be free, or we may charge a fee for using the Services. If you are using a free version of the Services, we will notify you before any Services you are then using begin carrying a fee, and if you wish to continue using such Services, you must pay all applicable fees for such Services. Note that if you elect to receive text messages through the Services, data and message rates may apply. Any and all such charges, fees or costs are your sole responsibility. You should consult with your wireless carrier to determine what rates, charges, fees or costs may apply to your use of the Services.
Certain of our Services, including Hungama Music, may be subject to payments now or in the future (the "Paid Services"). Please see our Paid Subscription Plan for a description of the current Paid Services. Please note that any payment terms presented to you in the process of using or signing up for a Paid Service are deemed part of these Terms.
We use a third-party payment processor (the "Payment Processor/Platform") to bill you through a payment account linked to your account on the Services (your "Billing Account") for use of the Paid Services. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processor in addition to these Terms. We are not responsible for error by the Payment Processor. By choosing to use Paid Services, you agree to pay us, through the Payment Processor, all charges at the prices then in effect for any use of such Paid Services in accordance with the applicable payment terms and you authorize us, through the Payment Processor, to charge your chosen payment provider (your "Payment Method"). You agree to make payment using that selected Payment Method. We reserve the right to correct any errors or mistakes that the Payment Processor makes even if it has already requested or received payment.
All subscription payments for the Services shall be processed exclusively through third-party platforms and/or processors integrated within the mobile application, namely Google Wallet (for Android users) and Apple Wallet (for iOS users). These integrations are intended to provide a secure, seamless, and globally recognized transaction experience. Please note that no other payment methods, including but not limited to Indian payment gateways (such as Razorpay, PayU, Paytm, PhonePe, UPI, or Net Banking), are available or permitted for processing transactions within the application. Users attempting to make payments via unsupported channels will not be able to successfully activate or renew subscriptions.
By subscribing, the user agrees to abide by the payment terms and billing cycles facilitated by by the platform used for the purchase , including but not limited the Apple App Store and Google Play Store policies. In case you subscribe via mobile carrier billing or local wallets, you agree to the payment terms and billing cycles laid down by such providers, including any applicable taxes or charges as per your local jurisdiction.
The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the platform of your chosen Payment Method. If we, through the Payment Processor, do not receive payment from you, you agree to pay all amounts due on your Billing Account upon demand.
Some of the Paid Services may consist of an initial period, for which there is a one-time charge, followed by recurring period charges as agreed to by you. By choosing a recurring payment plan, you acknowledge that such Services have an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. We may submit periodic charges (e.g., monthly) without further authorization from you, until you provide prior notice (receipt of which is confirmed by us) that you have cancelled your subscription or wish to change your payment method. Such notice will not affect charges already submitted before we could reasonably act on it.
To cancel your subscription or update your payment method, go to the "My Profile" section on the App, click on the Profile Icon, and then select "Manage Subscription. Further, if you choose to terminate your subscription, we will not be liable to provide any refunds for the current billing cycle.

You must provide current, complete and accurate information for your billing account. You must promptly update all information to keep your billing account current, complete and accurate (such as a change in billing address, credit card number or credit card expiration date), and you must promptly notify us or our payment processor if your payment method is cancelled (e.g., for loss or theft) or if you become aware of a potential breach of security, such as the unauthorized disclosure or use of your user name or password. Changes to such information can be made in your account settings. If you fail to provide any of the foregoing information, you agree that we may continue charging you for any use of paid services under your billing account unless you have terminated your paid services as set forth above.
If the amount to be charged to your Billing Account varies from the amount you preauthorized (other than due to applicable laws), you have the right to receive, and we shall provide, notice of the amount to be charged and the date of the charge before the scheduled date of the transaction. Any agreement you have with your payment provider will govern your use of your Payment Method. You agree that we may accumulate charges incurred and submit them as one or more aggregate charges during or at the end of each billing cycle.
Unless you opt out of auto-renewal, which can be done through your account settings, any Paid Services you have signed up for will be automatically extended for successive renewal periods of the same duration as the subscription term originally selected, at the then-current non-promotional rate. To change or resign your Paid Services at any time, go to account settings. If you terminate a Paid Service, you may use your subscription until the end of your then-current term and your subscription will not be renewed after your then-current term expires. However, you won't be eligible for a prorated or refund of any portion of the subscription fee paid for the then-current subscription period. If you do not want to continue to be charged on a recurring monthly basis, you must cancel the applicable Paid Service through your account settings or terminate your Company account before the end of the recurring term. Paid Services cannot be terminated before the end of the period for which you have already paid, and except as expressly provided in these terms, Hungama will not refund any fees that you have already paid.
Your non-termination or continued use of a Paid Service reaffirms that we are authorized to charge your Payment Method for that Paid Service. We may submit those charges for payment and you will be responsible for such charges. This does not waive our right to seek payment directly from you. Your charges may be payable in advance, in arrears, per usage, or as otherwise described when you initially selected to use the Paid Service.
Free Trials and Other Promotions. Any free trial or other promotion that provides access to a Paid Service must be used within the specified time of the trial. You must stop using a Paid Service before the end of the trial period in order to avoid being charged for that Paid Service. If you cancel prior to the end of the trial period and are inadvertently charged for a Paid Service, please contact us at support@hungama.com

Hungama may, at any time, terminate its legal agreement with you, including termination of your account, if you breach any provision of the Terms, as per the sole discretion of Hungama. Hungama holds the right to deny you Services without any express reason. Hungama may also terminate the relationship with you if Hungama is legally required to do so (e.g., when provision of Services provided by Hungama is, or becomes, unlawful); or if the partner(s) with whom Hungama offered the Services to you has terminated its relationship with Hungama or ceased to offer the Services to you; or the provision of the Services to you by Hungama is, in Hungama's opinion, no longer commercially viable.
You're free to stop using the Services at any time, by contacting us at support@hungama.com; please refer to our Privacy Policy, as well as the licenses described herein, to understand how we treat information you provide to us after you have stopped using our Services. Account termination may result in destruction of any content associated with your account, so keep that in mind before you decide to terminate your account.
Provisions that, by their nature, should survive termination of these Terms shall survive termination. By way of example, all of the following will survive termination: any obligation you have to pay us or indemnify us, any limitations on our liability, any terms regarding ownership or intellectual property rights, and terms regarding disputes between us, including without limitation the arbitration Agreement.

You expressly understand and agree that your use of the Services is at your sole risk and that the Services are provided "as is" and "as available". In particular, Hungama its subsidiaries and affiliates, and its licensors or suppliers do not represent or warrant to you that:
Your use of the Services will meet your requirements,
Your use of the Services will be uninterrupted, timely, secure, or free from technical errors
Any information obtained by you as a result of your use of the Services will be accurate, reliable, or legal and
That defects in the operation or functionality of any software provided to you as part of the Services will be corrected.
Any material downloaded or otherwise obtained through the use of the Services is done at your own discretion and risk, and you will be solely responsible for any damage to your computer system or other device, or loss of data that results from the download of any such material
Music streaming quality may vary depending on user subscription plans, device capabilities, and network conditions. Hungama Music does not guarantee uninterrupted or error-free playback at all times.
No advice or information, whether oral or written, obtained by you from Hungama, or through or from the Services shall create any warranty not expressly stated in the terms.
Hungama further expressly disclaims all warranties and conditions of any kind, whether express or implied, including, but not limited to, the implied warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement.
